Terms of Service
The terms that apply when you use the Fer Marketing website and services.
Effective date: October 23, 2026
Agreement
These Terms of Service govern your use of the website at https://fer.marketing and the services provided by Fer LLC, doing business as Fer Marketing, a Wyoming limited liability company at 30 N Gould St Ste R, Sheridan, WY 82801 ("Fer Marketing", "we", "us"). By using our website or services, you agree to these terms. If you agree on behalf of a business, you confirm you are authorized to do so.
Services
We provide web design, SEO, automations, and software integrations, including a platform that lets businesses connect their own WhatsApp Business accounts through Meta's WhatsApp Business Platform. The scope, price, and timeline of paid work are set in a proposal, order, or written agreement. If that agreement conflicts with these terms, the agreement controls.
Client responsibilities
You are responsible for the content you provide to us and for how you use our services. You agree to:
- provide accurate information and keep your account credentials secure;
- have the rights needed for any content, data, or accounts you give us access to;
- comply with all laws that apply to your business and your communications.
WhatsApp Business Platform
If you connect a WhatsApp Business account through our platform, you remain the owner of that account and are responsible for its use. You agree to:
- comply with the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy, and the Meta Commerce Policy, as updated by Meta;
- obtain valid opt-in consent from each person before sending them messages on WhatsApp, and honor requests to stop receiving messages;
- use approved message templates where Meta requires them, and not send spam or prohibited content;
- pay any fees Meta charges for conversations or messages on your account, unless we agree otherwise in writing.
Meta may suspend or restrict accounts that violate its policies. We are not responsible for actions Meta takes on your account. We may suspend your access to our platform if we believe your use violates these terms or Meta's policies.
Acceptable use
You may not use our website or services to break the law, infringe the rights of others, send unsolicited messages, distribute malware, or interfere with the operation or security of our systems or anyone else's.
Fees and payment
Fees for paid services are described in your proposal, order, or agreement. Unless stated otherwise, invoices are due when issued. We may pause work on overdue accounts.
Intellectual property
You keep ownership of the content and data you provide. Once you have paid in full, you own the deliverables created specifically for you, except for third-party components, which remain under their own licenses, and our pre-existing tools, code, and know-how, which we keep and license to you as needed to use the deliverables.
Privacy
Our Privacy Policy explains how we handle personal data. Deletion requests can be made as described on our Data Deletion Instructions page.
Third-party services
Our services rely on third-party platforms such as Meta, WhatsApp, hosting providers, and other software vendors. Their services are governed by their own terms, and we are not responsible for their availability or actions.
Disclaimers
Our website and services are provided "as is" and "as available". To the extent allowed by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific results, such as search rankings, traffic, or sales.
Limitation of liability
To the extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim related to our services is limited to the amount you paid us for those services in the three months before the claim arose.
Indemnity
You agree to defend and hold us harmless from claims arising from your content, your messages, your use of the services, or your violation of these terms or of Meta's policies.
Termination
You may stop using our services at any time. Either party may end ongoing services as described in the applicable agreement. We may suspend or end access for violations of these terms. Sections that by their nature should continue, such as payment, intellectual property, disclaimers, and limitation of liability, survive termination.
Governing law
These terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Wyoming, unless we agree otherwise in writing.
Changes
We may update these terms from time to time. The new version will be posted on this page with an updated effective date. Continued use of our website or services after a change means you accept the updated terms.
